Special Planning Circumstances

Ensure gifts to your most vulnerable loved ones are handled responsibly

Planning techniques for special circumstances may include additional trust documents, such as:

Special Needs Trusts~ If you have a loved one with a disability who relies on public benefits included in your plans, a special needs trust may be necessary to protect them.

Spendthrift Trusts~ If you have a loved one who is not responsible enough to handle an outright monetary gift, you can appoint a third party trustee and set the terms for the trust funds.

Planning Ahead for
the "Look Back"

Understand how assets and transfers affect eligibility for long term care benefits

MassHealth (Medicaid) benefits can cover the majority of long term care nursing home costs when an applicant is eligible.  As part of the eligibility review, MassHealth "looks back" 5 years to determine if any transfers were actually disqualifying "gifts."

While it is impossible to predict if/when nursing home care may be needed, it is helpful to know the rules, and take them into consideration before making gifts and property transfers.  There are strategies to help protect your assets from the future risk of long term care costs.

I offer long term care planning consultations for clients, as well as group information sessions.

MASSHEALTH (MEDICAID) PLANNING

Guidance for elders and loved ones facing long term nursing home care

who needs nursing home care

There are special rules that apply to married couples, affording more favorable opportunities to protect assets when one spouse needs nursing home care. Efficient and knowledgeable planning should minimize financial hardship for the spouse at home.

Community based services

There are programs to help cover costs of care at home or in an assisted living facility.  These include MassHealth community based programs, as well as the Aid and Attendance benefit for Veterans and their spouses.

Obtaining Guardianship & Conservatorship

If a loved one loses the capacity to make informed medical and personal decisions, without a health care proxy in place, a legal guardian may need to be appointed.

If a loved one no longer has the ability to manage financial and property matters, without a Durable Power of Attorney in place,  a legal conservator may need to be appointed.
